1969年, 樂隊改名為 "Badfinger", 各成員同居於一大屋, 低音結他手 Ron Giffiths 是唯一有妻子和週歲兒子一起, 他的妻子與 Tom Evans 和經理 Bill Collins 之間常有磨擦, 至同年十月, Ron Griffiths 决定要離開樂隊; 及後, Collinss 和 Evans 從多個樂手中挑選來自樂隊 "Gary Walker & The Rain" 的結他手 Joey Molland 補上, 亦由此起, Tom Evans 改任低音結他手。

樂隊住在經理 Bill Collins 的大屋, 生活亦有規限; Tom Evans 因失去女友的原故, 常獨自留在大屋, 在音樂室思考用歌曲來一抒內心的感受, 他翻看 Pete Ham 一首仍没有完成的歌曲 "If It's Love", 他把 "副歌 Chorus" 撰上, 改以另一曲名 "Is This Love?", 之後又覺得 "Chorus 副歌" 平淡, 亦缺少和唱的結構; 此刻, Pete Ham 出外約見女友剛回來 (大屋規定不准女友到訪), 他提議把三節副歌合而為一, 令歌曲推向激情, 並完成一首對愛情的脆弱充滿無力感的作品 "Is This Love?"。
在副歌 "I can't live, if living is without you 如果沒有你, 我不能活下去", 正是 Tom Evans 失去愛情的感受和哀嘆, 重複看過之後, 因感觸而再次把歌曲名字改為 "I Can't Live"; 不過, 經 Pete Ham 看過後, 認為對摯愛呼喊 "I can't live...." 是由於 "沒有妳 WITHOUT YOU" !

1970年十一月唱片面世, 在流行樂壇不被注目, 亦不被 Pete Ham 和 Tom Evans 看好, Apple Records 蘋果唱片公司衹把它收錄在專輯唱片 "No Dice" 當中, 在歐洲和北美並沒有印製過單曲細唱片, 亦由於當時公司的人事和財務遇上問題, 並邀請當時 The Rolling Stones 樂隊的經理 Allen Klein 接任管理, 而 Beatles 四個成員之中, 只有 Paul McCartney 反對他任這職位, Paul 亦因而不再沾手公司的業務。

"Without You" 面世之前, 樂隊經理 Bill Collins 已知道 Apple Records 蘋果唱片公司有所變動, 因此前往美國為樂隊的巡迴演出探路, 期間, 被介紹認識在 New York City 紐約市的商家 Stanley Polley, 於十一月和樂隊簽下業務合約, 組成 Badfinger Enterrprises, Inc. 担任公司副總裁與及負責樂隊在美國所有演出、唱片錄製、發行版權和財務管理。
儘管 Stanley Polley 當時亦是 Lou Christie, Blood, Sweat & Tear 和 Al Kooper 的經理, 在流行樂壇令業界欽佩, 但對 Badfinger 樂隊的管理卻令人質疑, 在1970-1971年度財務報表, 公司利潤衹有 US$24,500, 而 Polley 所得的佣金則高達 US$75,700, 樂隊在美國巡廻表演三個月, 雖然獲得好評, 支付薪金 Tom Evans US$6,200, Pete Ham US$6,000, Joey Molland US$8,300, Mike Gibbins US$6,800, 亦不知如何計算, 各人薪金並不相同。
